Fatal collision court case put off for a month

Family members of an Okotoks father of three killed in a collision in May got their first glimpse of one of two men charged in the incident.

Jody Sebryk and Benjamin Legere are both facing several charges in relation to a May 6 collision that claimed the life of 43-year-old Daniel Tillapaugh.

The case made its first appearance in Okotoks Provincial Court on Sept. 29 and was put over until Oct. 27 to give time for defence attorneys to receive disclosure from Crown prosecutors.

RCMP allege street racing and alcohol were factors in the collision. Police say that prior to the collision a black Mercedes was seen racing a motorcycle at around 1 a.m. just north of Okotoks. Both vehicles were travelling at high speeds when the Mercedes collided with a Toyota FJ Cruise driven by Tillapaugh.

Sebryk, 45, is charged with impaired driving causing death, impaired driving over 0.08 causing death, dangerous operation of a motor vehicle causing death, dangerous operation of a motor vehicle while street racing causing death and criminal negligence while street racing.

Legere, 25, is charged with dangerous operation of a motor vehicle causing death, dangerous operation of a motor vehicle while street racing causing death and criminal negligence while street racing.

Legere was in court on Sept. 29. Wearing a hat with jeans and a hoodie, he was represented by a legal agent who spoke on his behalf.

Neither Sebryk nor his attorney were in attendance. They were represented by an agent who spoke on their behalf to say they have not yet received disclosure from prosecutors.
