A man charged with raping a woman in a car while their child was present will have his case heard by a judge and jury in Calgary.
Police were called to a rural road in the MD of Foothills when a pair driving by were flagged down by the alleged victim.
A man was subsequently arrested in Calgary. His identity cannot be revealed to protect the victim.
The man’s preliminary hearing will be heard in Okotoks on Feb. 4. If a judge determines there is enough evidence the trial will be moved to Court of Queen’s Bench in Calgary.
